EBOOK SINGLE END USER LICENSE AGREEMENT
THIS IS A LEGAL AGREEMENT BETWEEN YOU AND PBJ MEDIA HOLDINGS LLC. BY DOWNLOADING THE EBOOK(S) FILE FROM THE PBJ STORE YOU AGREE TO BE BOUND BY THIS AGREEMENT.
GRANT OF LICENSE: PBJ Media Holdings LLC hereby grants you (the customer) the non-exclusive, non-transferable single user license to use the PDF (password protected) eBook(s) customer purchases and/or downloads subject to the restrictions contained herein. Unless specifically noted otherwise, the customer is purchasing an eBook PDF and not a physical, tangible publication.
Our eBooks are sold under license from book publishers. The PDF eBook may not be copied in its entirety. You may not rent, transfer, resell, lend or grant any rights to any of the PDF files and content contained hereon, or any compilation, derivative or collective work containing such files to any other person or organization without express prior written consent of PBJ MEDIA HOLDINGS LLC. You may not use this product on more than one computer, device or workstation at a time, nor on a network or a multi-user system, server, or torrents. If you wish to purchase additional licenses for additional users, contact the PBJ MEDIA HOLDINGS LLC.
This license agreement DOES PERMIT the following use of the files. You may use these files in your professional
readings, studies, and professional development. All information contained within any eBook on the site is for informational purposes only and the customer should not rely on the accuracy of such information. The views, opinions and writings expressed in the eBook(s) are those of the original author and do not reflect those of PBJ Media Holdings LLC or the related eBook publisher.
This license agreement DOES NOT PERMIT the following uses PDF eBook files contained within. You may not post any files or book files on any electronic bulletin board, put the images online in a downloadable format, copy, and/or print eBooks PDFs for re-sale, or use the images in a web site. You may not use or allow anyone else to use any of these to create pornographic, libelous, obscene, or defamatory content.
Using any files from this CD in a way not covered or specially prohibited by this agreement, without prior written consent from the Publisher, is a violation of Federal copyright law. This license is in force until it is terminated. If you do not comply with the terms and conditions above, this license automatically terminates. At termination, the product must be returned to the Publisher immediately without refund.
COPYRIGHT: All eBook files are owned by the designated Publisher or its licensors and are protected by the United States Copyright laws, international treaty provisions, and other applicable laws. No title to or intellectual property rights to the files or PDF eBooks, are transferred to you. PBJ Media Holdings LLC is acting as a reseller of eBook. The designated Publisher retains all rights not expressly granted by the license agreement. Illegal use, copying, duplicating, file sharing, unauthorized uploading to any server, network or multi-user devise and/or sharing of book content files beyond the single user license is strictly prohibited and the customer maybe liable for any misuse.
RETURN POLICY: Due to the nature of the media and license agreements with Publishers, eBooks purchased are final sales and non refundable or exchangeable.
LIMITED WARRANTY. PBJ MEDIA HOLDINGS LLC WARRANTS THE EBOOK PDF TO BE FREE FROM DEFECTS IN MATERIAL AND WORKMANSHIP FOR 30 DAYS FROM DELIVERY. YOUR SOLE AND EXCLUSIVE REMEDY FOR A BREACH OF THIS WARRANTY IS THE REPLACEMENT OF THE EBOOK PDF, AT THE OPTION OF PBJ MEDIA HOLDINGS LLC. PBJ MEDIA HOLDINGS LLC MAKES NO OTHER WARRANTY EITHER EXPRESSED OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR ANY PARTICULAR USE, OR COMPATIBILITY WITH ANY COMPUTER, EREADER, THIRD PART APPS, IPADS OR OTHER KIND OF EQUIPMENT. NEITHER PBJ MEDIA HOLDINGS LLC NOR ANY OF ITS TRUSTEES, AGENTS, EMPLOYEES, PUBLISHERS AUTHORS, DISTRIBUTORS, REPRESENTATIVES, OR ASSOCIATES SHALL BE LIABLE FOR ANY DAMAGES, WHETHER DIRECT, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL, ARISING OUT OF THE USE OF, OR INABILITY TO USE, ANY EBOOK OR ANY FILES OR IMAGES CONTAINED HEREWITHIN.
LIABILITY
The customer assumes all responsibility for any and all loss, theft, damage, or injury to the person, and hereby waives any claim or demand it may have against PBJ Media Holdings or its affiliates arising from such loss, theft, damage or injury. In addition, the customer agrees to defend, indemnify and hold harmless PBJ Media Holdings, LLC, its affiliates, publishers against any liabilities, obligations, damages, fines, suits, costs and expenses and claims of including, without limitation, attorneys’ fees and costs up through and including any appeal, arising from or in connection with the customers use of PBJ Media LLC’s website, store or eBooks.
GOVERNING LAW AND GENERAL PROVISIONS
This agreement will be governed by the laws in force in the State of Georgia excluding the application of its conflicts of law rules. This Agreement will not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded. If any part of this Agreement is found void and unenforceable, it will not affect the validity of the balance of the Agreement, which shall remain valid and enforceable according to its terms. You agree that the eBooks(s) will not be shipped, transferred, or exported into any country or used in any manner prohibited by the United States Export Administration Act or any other export laws, restrictions, or regulations. This Agreement shall automatically terminate upon failure by you to comply with its terms.
